Terms of Service Agreement
This "Terms of Service Agreement" outlines the mutual expectations and responsibilities of both Cleveland Best Pest Control LLC ("CBPC") and the customer ("Consumer").
Cancel Agreement
Either party may cancel this agreement within 72 hours of the contract date without penalty.
Service
CBPC provides pest control services to reduce infestation levels and maintain acceptable levels through regular service intervals, using pet, human, and earth-friendly practices. While we aim to control pests, complete elimination of future pest occurrences is not guaranteed. If an issue arises, please report it, and we will schedule a callback to retreat the affected area within a reasonable time (72 hours).
Customer Responsibilities
The effectiveness of pest control services depends on the customer's cooperation in housekeeping, sanitation, maintenance, and accessibility of treatment areas. Customers are responsible for moving furniture or items that obstruct the treatment area(s). CBPC reserves the right to cancel or reschedule a treatment if the area is obstructed. Customers must also actively seek to schedule regular maintenance services. CBPC will attempt to contact customers, but it is the customer's responsibility to ensure services are scheduled.
Interior Service
CBPC's interior service does not guarantee control for stored product pests, flying insects, bedbugs, fleas, ticks, vertebrates, or stinging/biting insects, unless otherwise specified. Ensuring the structure is sealed to outside elements is crucial for the success of the pest control program. Customers must repair and seal entry points as recommended by technicians.
Exterior Service
CBPC provides exterior pest control services focused on the structure. Treating the exterior is essential to prevent pests from entering. Customers are responsible for maintaining and repairing entry points such as doors, windows, and pipes. CBPC may recommend additional control measures beyond the normal scope of work, which may require contracting a specialist.
Cancel Scheduled Maintenance Service
Life happens! We understand that sometimes you may need to cancel an appointment. Our policy allows for two courtesy "Late Cancellations" per year (one every six months). If you cancel within 24 hours of the scheduled service beyond these allowances, a $50.00 cancellation fee will apply.
Future Damage
CBPC is not responsible for, and does not guarantee against, present or future damage to the structure or contents.
Guarantee
Depending on the service type selected, CBPC guarantees to control included pests in and around your home through regular pest control services. If infestation levels are observed during the guarantee period, CBPC will return at no cost to make corrections. A single insect sighting does not indicate infestation.
Payment
The customer assumes full financial responsibility for services rendered. Payment is due in full at the time of booking. A late fee of $25.00 applies to unpaid invoices 30 days or more past the date of the initial service. CBPC may discontinue service and initiate collection proceedings if outstanding balances are not paid within 60 days. Customers agree to pay all associated costs, including attorney’s fees and interest on overdue amounts.
Service Exclusion
This agreement does not include control or prevention of wood-infesting organisms such as termites, powder post beetles, wood borers, carpenter ants, bees, or bedbugs. CBPC cannot guarantee against re-infestation from neighboring areas or between service intervals.
Waiver
Customers expressly release and waive all liability claims against CBPC for compensation, re-treatments, or repairs for past, present, or future insect or rodent damage, personal injury, or damages arising from pests or contact with CBPC products.
Acts of God and Other Events
Certain events beyond CBPC's control, such as heavy rain, strong winds, hurricanes, extreme temperatures, governmental actions, or other acts of God, may affect our ability to perform services. CBPC is not liable for postponing, canceling, or terminating treatment due to such events.
